Terms of Service
Our goal is to provide a seamless, professional, and high-quality experience for all CMTC attendees. These Service Terms and Conditions (“Terms of Service”) govern all of your dealings with C.M.T.C i.n.c. (“CMTC”) and participation in CMTC events.
Below you will find the full Terms of Service, which include but are not limited to, the specific items below that we are highlighting for you:
- CMTC is an invite-only event. Contestants must successfully audition in order to be invited to register for a CMTC event.
- All convention fees – including fees associated with contestant registration fees, visitor passes and awards guest tickets – are payable when due and are non-refundable.
Registration Fee
The registration base fee includes: (a) four (4) convention days; (b) access to all seminars and workshops; (c) access to the Friday theme party dance; (d) a personalized certificate of participation; (e) entrance to the awards reception, ceremony, and dance; and (f) the inclusion of the Contestant’s photo in the CMTC program book (provided that the Contestant’s photo is uploaded to the CMTC website by the assigned deadline date; the photo meets the upload specifications listed on the CMTC website; and the Contestant’s registration fees have been paid in full by the balance deadline date).
Competitions
Each Contestant must select a minimum of three (3) competitions at the time of registration. Competitions are not included in the registration base fee and each competition is priced at $50.00 plus HST if paid before the assigned deadline date. Following the registration balance deadline date, each competition is priced at $75.00 plus HST. Contestants cannot remove competitions once registered; however, one competition may be exchanged for another competition up until the assigned deadline date.
Visitor Passes
Visitor passes include: (a) four (4) convention days; (b) competitions that are open to an audience (see CMTC Competition Rules and Regulations); (c) seminars and workshops; (d) access to the Friday theme party dance; and (e) entrance to the awards reception, ceremony, and dance. A Visitor’s Pass must be associated with a contestant and attached to a contestant’s account.
Awards Guest Tickets
Awards guest tickets include admittance to the awards reception, ceremony, and dance. An Awards Guest Ticket is included in both the Contestant’s Registration package as well as the Visitor’s Pass package. Awards Guest Tickets must be associated with a contestant and attached to a contestant’s account.
Down Payment
The $195.00 down payment is non-refundable and non-transferable.
Payment Deadline
All registration payments and all fees are due by the assigned deadline date, and ALL PAYMENTS AND FEES ARE NON-REFUNDABLE regardless of the registrant’s ability to attend CMTC.
No Refunds
All convention fees – including fees associated with visitor passes and awards guest tickets – are payable when due and are NON-REFUNDABLE. The registrant is responsible for the full balance owing regardless of their ability to attend CMTC.
Late Payment Plan Fee
With reference to the payment plans offered by CMTC Inc., a fee of $25.00 plus applicable taxes will be added to late payments (i.e., payments received after the first of the month).
Collection of Outstanding Balances
CMTC reserves the right to collect any balances due under the terms of CMTC’s Registration Agreement and the online registration form. Upon registration, attendees are required to acknowledge that they understand and provide authorization that in the event their registration balance is not paid by the registration fee balance deadline, that CMTC may charge the remaining balance to the credit card on file with their registration.
Late Balance Payment Fee
Late balances paid after the balance due deadline date, are subject to a $100.00 plus applicable taxes late fee.
Transfer Policy
Under extenuating circumstances, if a Contestant for reasons not within the registrant’s control is unable to attend CMTC, at the sole discretion of CMTC Inc. only, a credit may be given towards the next convention. To defer the registration to the next convention, the Contestant must pay his/her registration fees in full on or before the assigned registration balance deadline date. The Contestant must then complete the Request to Transfer Form on the CMTC website together with the details of reasons the Contestant is not able to attend. The date on which the Contestant submits the Request to Transfer Form will determine the percentage of the Contestant’s registration fees that will be carried over to the next convention if the request is approved by CMTC Inc.
Receipts
It is the registrants responsibility to retain a copy of all registration payment receipts and CMTC Agreements as a reference and for their records.
Additional Costs and Expenses
Attendees are fully responsible for: (a) any and all additional costs or expenses incurred at the convention site; (b) any and all costs or expenses incurred with any photographers; (c) any and all costs for housing and hotels; and (d) any and all costs or expenses incurred in travelling to and from the convention site.
Convention Itinerary and Competition Rules
Contestants are required to follow the official itinerary and abide by the criteria, rules, and regulations set forth for each competition/event in which they are participating in. Due to the nature of the event, contestants must be aware that the itinerary may change from time to time right up to start times, and it is the contestants responsibility to update my information regarding the same. Attendees must be further aware that seminars, workshops, receptions, ceremonies, dances and other components of CMTC may from time to time need to be rescheduled or even cancelled and same shall not entitle a Contestant nor guest to any refunds.
Disqualification
If a contestant is disqualified from CMTC, or unable to attend for any reason, the contestant will not be entitled to any refund of fees paid to CMTC Inc.
Dismissal from CMTC or Hotel Premises
If an attendee is dismissed from CMTC and/or the hotel premises they will not be entitled to any refund of fees paid to CMTC Inc.
Booking Hotel Accommodations
Attendees are responsible for booking their own hotel accommodations directly through the Sheraton Parkway Toronto North Hotel or such other accommodation of their choosing. Attendees should understand that the Sheraton Parkway Toronto North Hotel offers a CMTC rate and that this special discounted rate is limited both in number and in time frame.
Compliance with Hotel Rules
Attendees must abide by the rules set forth by the Sheraton Parkway Toronto North Hotel and will be held financially responsible for the removal or destruction of any hotel or CMTC property as a consequence of their actions, omissions or negligence or of the minor(s) for whom they are guardian. There will be a fine levied on attendees if they are responsible for any smoking in a non-smoking room booked.
Compliance with Laws, Ordinances, and Regulations
Attendees are subject to all city, provincial, and federal laws, ordinances, and regulations in force in the Province of Ontario.
Competitions, Events, Seminars, and Workshops
CMTC competitions, events, seminars, and workshops are for educational purposes only and will not secure or provide opportunity for (a) employment in the modelling or entertainment industries or (b) representation by an agent.
Future Opportunities of Attendees as a Result of Attending CMTC
CMTC Inc. does not guarantee that Attendees will: (a) be offered contracts, (b) be offered placement opportunities, (c) receive trophies, and/or (d) receive callbacks as a result of attending CMTC.
Electronic Communications
Those who RSVP for a CMTC audition and information seminar, register for a CMTC event, and/or sign up for the CMTC mailing list, will receive electronic messages from CMTC Inc. including, but not limited to, promotions about the CMTC event, opportunities, other notifications, and offers..
Communications with Contestants Ages 18 and Older
Pursuant to Canadian privacy law, if the Contestant is 18 years of age or older, CMTC will not communicate or engage in dealings with the parent, legal guardian, or other proxies or persons claiming to represent the interests of the Contestant. In such cases, the Contestant must deal with CMTC directly.
Loss or Damage of Property
CMTC Inc. assumes no responsibility for the loss, theft, or damage of Attendees’ property. Attendees cannot hold CMTC Inc. responsible for the loss, theft, or damage of their property.
Personal Injuries
CMTC Inc. is not responsible for any injury that may occur to an attendee in conjunction with CMTC being held at the Sheraton Parkway Toronto North Hotel or arising in any manner or connected in any way with their participation in CMTC including any such injuries or treatment of same arising as a consequence of the negligence or wrongful conduct of any attendee, guest, participant, employee, agent or invitee of CMTC and/or the Sheraton Parkway Toronto North Hotel and upon registration for a CMTC event, attendees release CMTC Inc. of any such claim. Emergency First Aid Treatment
Attendees grant permission to their director and/or a representative of CMTC Inc. to render or seek emergency first aid treatment on behalf of them if it appears necessary.
Granting of Rights for Photography, Film, and Audio Material for Event Documentation and Public Reporting
In consideration of the potential for additional publicity, attendees authorize the Canadian Model and Talent Convention, CMTC Inc., to copyright, reproduce, or otherwise use anywhere in the world, forever, any or all photographs, video, television, and other tapes, likeness and characterization for any and all purposes including, but not limited to, the commercial use by CMTC Inc. for advertising, publicity, and trade, notwithstanding any of the forgoing may include attendee’s private or personal information. By signing up for the CMTC audition or registering for a CMTC event, attendees warrant that they have not restricted the use of their name, photograph, or resemblance to any person, firm, corporation, or other entity. Fulfillment and Jurisdiction
CMTC’s Agreement is governed by the laws of the Province of Ontario and the laws of Canada applicable therein. All disputes arising in connection with CMTC’s Agreements shall be determined exclusively by courts in Ontario.
Severability Clause
The unenforceability or invalidity of any clause in CMTC’s Agreement shall not have an impact on the enforceability or validity of any other clause. Any unenforceable or invalid clause shall be regarded as removed from CMTC’s Agreement to the extent of its unenforceability and invalidity. Therefore, CMTC’s Agreement shall be interpreted and enforced as if it did not contain the said clause to the extent of its unenforceability and invalidity.
Cancellation Policy
Registration cancellations will not be accepted.
Force Majeure
Should any event occur which is not within the control of CMTC Inc. but which makes it impossible or not desirable (as determined by CMTC Inc. in its sole discretion) to conduct CMTC or a seminar, contest, workshop, reception, ceremony or dance during CMTC, as scheduled, (such events to include without limitation acts of God, war, acts of terrorism or threats of terrorism, labour disputes, fire, pandemics, adverse weather, government orders) CMTC Inc. shall use reasonable efforts to re-schedule CMTC to alternate time and dates, which may simply be the next annual CMTC, and no registration fees, visitor fees, award guest tickets, passes or down payments shall be refunded but in CMTC Inc.’s discretion may be partially or entirely credited to the re-scheduled CMTC.
CODE OF CONDUCT
All participants must adhere to CMTC Inc.’s Code of Conduct. Behaviour found by CMTC Inc. not to be in compliance with the Code of Conduct will result in the Participant being refused admission or ejected from CMTC without refund. WAIVER AND RELEASE OF LIABILITY
Contestants, Visitors, and Guest Awards Ticket holders attend and/or participate at CMTC entirely at their sole risk. Neither CMTC Inc. nor Sheraton Parkway Toronto North Hotel nor any of their respective agents, representatives, directors, officeres, employees, attendees, guests, invitees, successors and/or assigns (the “Releases”) are or will be responsible or liable to attendees or any third party for any and all claims, demands, expenses, causes of actions, damages, and losses resulting from, arising out of, in connection with or related to, the attendees attendance/participation at CMTC, including without limitation, damages arising from, or in connection with, personal injury or death or temporary or permanent disability or damage to property; however caused by any act, omission, negligence or willful misconduct of the Releasees or any other participant, attendee, contestant, visitor, and/or awards guest at CMTC.
